Abstract

Each term relating to financial transactions has two or more levels of meanings, within the framework of the same semantic field which is here the field of financial transactions. This term is predisposed to a reigning duality composed of Muslim law and positive law, that is to say two meanings at least: an original meaning and a modern meaning. The translator must then pursue his meaning through the scientific field to translate it.

Taking into account the constant renewal of financial transactions, the development of the two regimes: the regime of Muslim law and the regime of positive law generates new terms and other terms that carry different meanings which imposes the need to determine their concepts; and also generates other terms borrowed from their original meanings in favor of new meanings. The relationship between the original and modern meanings persists.

Thus, the translator is inclined to solve within the framework of the legal regime the difficulty of continuing the evolution of the meaning of the financial term while considering it as a linguistic object for the purpose of translating it.
